Terms of use

These terms apply to the use of the DuoVitaal app and this website. DuoVitaal is provided by Arnout van der Vorst in the Netherlands ("we"). By using the app you agree to these terms. How we handle your data is described in the privacy statement. If the Dutch and English versions differ, the Dutch version applies.

1. What DuoVitaal is

DuoVitaal is an app for a healthier daily rhythm: workouts, assignments, a journal, challenges, buddies and coaching. Athletes use the app for free. Coaching features will later have their own prices and terms; you'll hear about them in advance.

2. Your account

• You can use the app without an account first. To keep your progress, you link an account.
• You provide correct details and keep your sign-in to yourself. What happens with your account is your responsibility.
• DuoVitaal is meant for people aged 16 and over. If you're younger, only use the app with permission from your parent or guardian.
• You can always delete your account in the app. See Delete your account.

3. Training safely

DuoVitaal offers general workouts and lifestyle tips. That isn't medical advice and doesn't replace a doctor or physiotherapist.

• If you're unsure about your health, are pregnant, are recovering from an injury or have a condition, check with a doctor first.
• Listen to your body. Stop if you feel pain, dizziness or shortness of breath.
• You train at your own risk and in a safe environment.

4. Coaching between users

Coaches in DuoVitaal are independent users; they don't work for us. A coach is responsible for their own advice, assignments, workouts and rewards, and for the arrangements they make with clients. We don't check qualifications or experience unless we say so explicitly.

As a coach you handle what clients share with you carefully, use it only for coaching within DuoVitaal and follow the law, including privacy law. Rewards you promise, you deliver yourself.

5. Community rules

DuoVitaal is there to encourage each other. So you don't:

• harass, insult, threaten or discriminate against others;
• share sexual, violent, unlawful or misleading content;
• pretend to be someone else, or share other people's data without their permission;
• send spam or advertising, or misuse, hack or overload the app.

If you see something that isn't right, report it in the app or block the user. We may remove content and block accounts temporarily or permanently when someone breaks these rules.

6. What you share

What you put in DuoVitaal (messages, photos, notes, assignments, exercise videos) stays yours. You allow us to store it and show it to the people you share it with, as long as that's needed to make the app work. You only share things you have the rights to.

As a coach you give your clients the right to keep using the workout plans, programmes and assignments you shared with them, even if you delete your account.

7. The app itself

The app, the exercise videos, texts and design belong to us or our licensors. You may use them in the app, not copy or distribute them.

We do our best to keep DuoVitaal working well and safely, but can't promise the app is always available and free of errors. We may change, add or stop features. We'll announce important changes in advance.

8. Liability

To the extent the law allows, we're not liable for damage caused by using the app, by training, or by advice or content from other users, including coaches. This doesn't apply in case of intent or deliberate recklessness on our side, and it doesn't limit any rights you have as a consumer under the law.

9. Changes and ending

We may change these terms. We'll announce important changes in the app before they take effect. If you don't agree, you can stop and delete your account. You can always stop; we can end your account if you break these terms.

10. Law and contact

These terms are governed by Dutch law. If we can't resolve a dispute together, it goes to the competent court in the Netherlands; as a consumer you may also go to the court where you live. Questions or complaints: info@duovitaal.com.
